RE: The tariff classification of a Preschool Games Rolling Back Pack from China

Dear Ms. Rose:

In your letter dated April 26, 2007, you requested a tariff classification ruling.

You are requesting the tariff classification on a product that has been identified as a Preschool Games Rolling Back Pack; there is no designated item number indicated. The submitted sample is a child’s novelty backpack constructed of plastic sheeting material. It features a three-sided zippered opening, two nylon shoulder straps, and one large storage compartment. The backpack also has two plastic wheels and a plastic pull-out handle. The backpack will be imported and sold with four preschool games inside as follows: Candy Land, Chutes and Ladders, Memory, and Hi Ho Cherry O. The outside of the backpack will indicate the names of the games included with it. Each game will be packed in a plastic zip lock bag labeled with the game’s name. The sample will be returned, as requested by your office.

The backpack and its contents will be separately classified for the purposes of the tariff.

The applicable subheading for the backpack will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for travel, sport, and similar bags, with outer surface of a sheeting of plastics. The rate of duty will be 20% ad valorem.

The applicable subheading for the 4 preschool board games included in the backpack will be 9504.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for articles for arcade, table or parlor games…parts and accessories thereof…other: chess, checkers, parchisi, backgammon, darts and other games played on boards of a special design, all the foregoing games and parts thereof (including their boards)…any of the foregoing games in combination with each other, or with other games…poker chips and dice. The rate of duty will be free. Duty rates are provided for your convenience and are subject to change. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
